McKay, Barbara of Ugadale |
| Notes |
- The identity of the child buried in linen in December 1708 is unknown, but given the later date, he or she was likely the child of his second wife, Barbara McKay, rather than his first wife.
Included with the assize record is a memorial stating that his wife had been pregnant for five months and “that [th]e birth was not tymelie and that the birth was in peenes to the great Danger of the mo[the]r.”
This note was undoubtedly written in response to the 1690 statute titled “Act anent murdering of children,” which states that if a woman concealed her pregnancy and didn’t call for assistance during the birth, she could be held liable for murder if the child died or went missing.
